Sneez, LLC (“us”, “we”, or “our”) operates the Sneez platform, including its website (the “Website”) and mobile application (the “App”). The App collects illness data from healthcare providers and symptom data from its users, aggregates the data into actionable information, and reports the aggregated information to its users for their use and decision-making. The App and the Website are collectively, the “Service”.

This Privacy Policy informs you of our policies regarding the collection, use and disclosure of information, including Personal Information (defined below), when you use our Service. Your use of the Service reflects your acceptance of this Privacy Policy. If you disagree with any portion of this Privacy Policy, your sole remedy is to immediately discontinue using the App and/or our Website. Unless otherwise defined in this Privacy Policy, terms used in this Privacy Policy have the same meanings as in our Terms of Use. Along with this Privacy Policy, please review our Terms of Use, which also govern your access to and use of the Service.

You must be at least 18 years of age (or older if the age of majority is higher than 18 where you reside) to use our Service. For more information, please see the section on Children’s Privacy below. Sneez, LLC is not a healthcare provider and the Service is not a medical or healthcare service; neither diagnoses or treats a medical condition. The Service is purely an information service. The information users submit through the Service is not protected under HIPAA (Health Insurance Portability and Accountability Act).

1. Information Collection and Use

Personal Information

“Personal Information” is information that can be used to individually identify a specific person. You may use the Website without providing Personal Information to us, unless you elect to use the Website “contact us” feature, in which case we request your name and email address to be able to respond to your inquiry.

In order to use the App, you will need to create an account. As part of account creation, we require email address and zip code; all other fields are optional. You may optionally create profiles within your account for household members, for whom we request that you provide the same information as above. By disclosing Personal Information of household members, you represent and warrant to us that you have a right to disclose that information.

We collect and use your Personal Information for a variety of business purposes, including to respond to your requests (for example, to set up an account), to respond to your inquiries, to provide the Service that you request, to communicate with you about our Service, to provide users with information about our Service, and to do all things necessary to administer the App, the Website and our Service, and to manage, protect and improve them. We require a user’s zip code in order to send users relevant alert notifications of specific disease outbreaks occurring in their area. Information that users provide that is deemed optional may be used to make offers and provide relevant information to users based on such information. Examples include offers to participate in clinical trials that are gender-specific, such as breast cancer studies that are only relevant to women and prostate cancer studies that are only relevant to men. Additionally, there may be gender-specific offers, information and services that are only relevant to certain users by gender. We request birth year information because many infections, preventative services, products, offerings, and clinical trials are relevant only to users of specific ages. By using the Service, you agree to the collection and use of your Personal Information in accordance with this Privacy Policy.

Sneez, LLC also collects geolocation data through the App in order to make symptom information available in the App more relevant to our users. For additional detail on use of location data, see “Location Data” below.

Location Information

Symptom information logged by individual users of the App is connected to user device-based locations, or user-reported zip codes and other locations. Only aggregated, de-identified symptom information, across locations, is intended to be visible to users of the App. Individual users and their household members, if any, for whom symptoms are reported are not intended to be individually identified through the App’s illness reporting given the App seeks to display possible illness trends across users in particular locations.   You can enable or disable location services when you use our App at any time, through your mobile device settings. Please be aware, however, that if you disable location services, certain features of our Service and App may not work as intended.

Log Data

When you use the Service, we as well as our service providers, may use assorted technologies that automatically or passively collect information about how the App or Website are accessed and used. For example, when you access the Service by or through a mobile device, we may collect certain information automatically, including, but not limited to, the type of mobile device you use, your mobile device unique ID, the IP address of your mobile device, your mobile operating system, the type of mobile Internet browser you use and other statistics (“Log Data”). Log Data is not intended to be personally identifying, but if we associate it with you as an identifiable person, we will treat it as Personal Information.

Cookies

We use cookies to collect information in order to deliver and improve the Service. Cookies are files with a small amount of data, which may include an anonymous unique identifier. Cookies are sent to your browser from a web site and transferred to your device.

You can instruct your browser to refuse all cookies, to delete cookies that have already been installed in your browser’s cookie folder or to indicate when a cookie is being sent. The Help feature on most browsers provide information on how to accept cookies, delete or disable cookies or to notify you when receiving a new cookie. If you do not accept cookies, please be aware that you may not be able to use or access some features of our Service and some features and services of our Service may not work as intended.

In addition to Log Data, we, or our service providers, use cookies to collect information in order to improve our services for you, to facilitate navigation and to personalize your experience while using the Service. We also use cookie data and Log Data to maintain and help diagnose problems with our Service, to build up marketing profiles, to aid strategic development and to help administer and audit usage of the Service. Cookie data is not intended to be personally identifying, but if we associate it with you as an identifiable person, we will treat it as Personal Information.

2. Advertising and Re-marketing Using Reported Data

Sneez, LLC may allow for other companies to conduct advertising campaigns on the App, or to deliver promotional incentives such as coupons within the App targeted to a specific user’s logged symptoms or to a user-cluster’s (example: zip code) aggregated illness or symptom profile. If you click on any linked advertisements, you may leave our App and go to websites that we do not control. If you decide to visit the third-party websites or advertisers, you do so at your own risk and it is your responsibility to read and comply with the privacy statement on those websites.

3. Do Not Track Disclosure; Third Party Tracking

We do not support Do Not Track (“DNT”) signals or messages and we do not presently have the capability to omit you from usage analytics to the extent that your browser or device sends us a DNT signal or message. Do Not Track is a preference you can set in your web browser to inform websites that you do not want to be tracked. You may be able to enable or disable Do Not Track by visiting the Preferences or Settings page of your web browser. Third parties, other than our vendors (such as our website analytics provider), do not have authorization from us to track which websites you visited prior to and after using the Service. That said, we cannot control third party tracking and there may be some third party tracking that occurs without our knowledge or consent.

4. Information We Share With Others

Business Partners

Sneez, LLC reserves the right, subject to applicable laws and the terms of this Privacy Policy, to share, or sell, any data we collect, including, illness data, with third parties, including interested health systems.

Service Providers

We may disclose your Personal Information and other information described under this Privacy Policy to third party companies and individuals we engage to facilitate our Service, to provide the Service on our behalf, to perform Service-related services and/or to assist us in analyzing how our Service is used.

Business Transaction

If Sneez, LLC is involved in a merger, acquisition, reorganization, liquidation, change of control or sale, all information we collect, including your Personal Information, may be transferred as a business asset.

Required by Law; Investigations

We reserve the right to disclose any information we collect, including your Personal Information, as needed if that information is requested by law enforcement or public health agencies or if we are required to do so by law, treaty, regulation, subpoena, court order, or by a government entity. We also may disclose your Personal Information to third parties if we have reason to believe that disclosing such information is necessary to conduct investigations of possible breaches of law, to cooperate in any legal investigation, or to identify, contact, or bring legal action against someone who may be violating any agreement with us, including our Terms of Use.

If you wish to correct or update your Personal Information, please contact us at Contact@sneezapp.com or, if you have an online account, you may be able to log into your account and update certain account information.  We may not be able to correct or update your Personal Information previously provided by us to third parties (for example, if you are a household member of a user).

6. Security

We strive to implement and maintain commercially reasonable security for Personal Information we collect through the Service.  However, please be aware that no method of transmission over the internet, or method of electronic storage is 100% secure and we are unable to guarantee the absolute security of the Personal Information we have collected from you.

7. Links to Other Sites

Our Service and App may contain links to other sites that are not operated by us. If you click on a third party link, you will be directed to that third party’s site. We strongly advise you to review the Privacy Policy of every site you visit. We have no control over, and assume no responsibility for the content, privacy policies or practices of any third party sites or services.

8. Children's Privacy

The Service is not directed to children under 13. Only persons age 18 (or older if the age of majority is higher where they reside) have permission to use our Service. Parents or legal guardians may use the Service to share their children’s information as a household member, but the parent or legal guardian should not let their children use the App or Service themselves if they are under age. When you submit information to the App on a child, you agree that the submission of such information is voluntary and that you are the child’s parent or legal guardian and have permission to submit such information.
We do not knowingly collect personally identifiable information from children under 13. If you are a parent or guardian and you learn that your children under 13 have provided us with Personal Information, please contact us at Contact@sneezapp.com. If we become aware that we have inadvertently collected Personal Information from a child under age 13, we will take steps to remove that information from our servers.

9. Notice to Residents of Countries Outside the United States

We are headquartered in the United States. If you are located outside of the United States, be advised that any information you provide to us will be transferred to and stored in the United States and that, by submitting information to us, you explicitly authorize its transfer and storage within the United States. We will protect the privacy and security of personal information according to this Privacy Policy regardless of where it is processed or stored.

10. Your California Privacy Rights

Pursuant to Section 1798.83 of the California Civil Code, residents of California have the right to request from a business, with whom the California resident has an established business relationship, what types of personal information, if any, the business shares with third parties for direct marketing purposes by such third party and the identities of the third parties with whom the business has shared such information in the immediately preceding calendar year. 11. Changes to this Privacy

We reserve the right to update or change our Privacy Policy at any time and you should check this Privacy Policy periodically. Your continued use of the Service after we post any modifications to the Privacy Policy through the Service will constitute your acknowledgment of the modifications and your consent to abide and be bound by the modified Privacy Policy.

If you do not consent to our privacy practices as described in the revised version of the Privacy Policy, please do not use the Service in any manner. We will continue to treat previously collected information in accordance with the privacy practices described in the applicable, prior version of this Privacy Policy or as otherwise required by applicable law.
